1. Agreement to Terms

By downloading, installing, or using the Fermento mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download, install, and use the App on your personal mobile devices
Use the App solely for your personal, non-commercial purposes
Access and use the App's features as intended for fermentation tracking

3. Intended Use

Important: Fermento is a timing and tracking tool only. We do not provide fermentation advice, recipes, or safety guidance. Users are responsible for their own fermentation practices and food safety.

The App is designed to help track fermentation timers and phases
Users must follow proper food safety and fermentation practices
We are not responsible for the quality, safety, or results of your fermentations
Consult qualified sources for fermentation recipes and safety guidelines

4. Intellectual Property

The App and all content, features, and functionality (including but not limited to all information, software, text, displays, images, and design) are owned by Andrej Jasso and are protected by international copyright, trademark, and other intellectual property laws.

5. Restrictions

You agree NOT to:

Modify, adapt, translate, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the App for any commercial purposes
Rent, lease, lend, sell, redistribute, or sublicense the App
Copy or duplicate the App except as expressly permitted
Use the App in violation of any applicable laws or regulations

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Food Safety Disclaimer:

We do not guarantee the safety or quality of fermented products
Users are solely responsible for food safety practices
Improper fermentation can result in spoilage or illness
Consult expert sources for safe fermentation practices

We do not warrant that:

The App will meet your requirements or expectations
The App will be uninterrupted, timely, secure, or error-free
The timing accuracy will be perfect in all situations
Any errors in the App will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANDREJ JASSO BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury, illness, or property damage
Spoiled or unsafe fermented products
Any damages arising from your use or inability to use the App
Any damages related to fermentation practices or results

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (if any).

8. Indemnification

You agree to indemnify, defend, and hold harmless Andrej Jasso from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the App
Your violation of these Terms
Your fermentation practices and results
Any food safety issues or illnesses related to your fermented products
Your violation of any third-party rights

9. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. Updates are provided free of charge. However:

Updates may require the latest version of your operating system
We are not obligated to provide updates indefinitely
We may discontinue the App at any time without liability

10. Privacy and Data

Your use of the App is also governed by our Privacy Policy. By using Fermento, you consent to our data practices as described in the Privacy Policy.

We do not collect, store, or share your personal data
All data is stored locally on your device
No accounts or registration required

11. Geographic Restrictions

The App is available worldwide through the Apple App Store and Google Play Store, subject to availability in your region. You are responsible for compliance with local laws and food safety regulations.

12. Termination

We reserve the right to:

Discontinue the App at any time
Terminate or suspend your access for violations of these Terms
Modify or remove features without notice

Upon termination, you must cease all use of the App and delete all copies.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Andrej Jasso regarding the use of the App.

17. App Store Requirements

As required by Apple and Google:

These Terms are between you and Andrej Jasso, not Apple or Google
Apple and Google have no obligation to provide support or maintenance for the App
Apple and Google are not responsible for any product liability claims
Apple and Google are not responsible for any intellectual property infringement claims
Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms
